What Are The Army Regulations That States The Adultery Laws Of A Divorce?

A man is in the military, and him and his wife are going through a divorce, and his wife isn’t in the military. She commits adultery, and admits it. However, I haven’t been able to find a law that states whether he has to pay her anything or not. HELP!!!

    I’m sorry, but, under UCMJ, adultery is a punishable offense. However, that’s for the service member, not the service member’s spouse. He is bound by military laws, she is not. She is only bound by civilian laws. It depends on your state, but most states these days are no fault divorce states, so it doesn’t matter why they get a divorce, the divorce process is still the same. He needs to take this up with a divorce lawyer to see if he’s entitled to pursue this. But it’s definitely not a military issue since she’s not in the military. She didn’t swear any oath to the Army. Sorry!

    Army has nothing to do with a divorce. The military in general do not get involved in personal issues unless they go so far as to negatively affect the military member’s duties.
    Alimony/spousal support is actually harder to get than most think. The judge bases his decision on a lot of aspects of the marriage – the length, the cause of the divorce, who works/who does not, etc)
    If she cheated it could possibly affect her alimony request, to my knowledge there is no law that specifies whether or not one who committed adultery can receive alimony.

    Pays for what? Spousal support? Depends on the state. 50% of the marital assets, yes, unless the judge penalizes her for the adultury. Child support would be unaffected.
    EDIT: If you aren’t in the military, you aren’t subject to military law. The divorce would be conducted under the laws of the state you’re in. You’re a crappy wife, but you can’t be held accountable to the military laws.

    The military regulations concerning adultery is only for two members of the military. For example, an army man and a navy woman who are married but not to each other have sex – they can both be charged with adultery but their civilian spouses can’t. Although they are probably cheating too – LOL.
